Terms and Conditions – SO Catering
By ordering catering from Soul Origin (NZ) Limited (‘Soul Origin’), you agree and accept to be bound by the following Terms and Conditions (‘Terms’).
Information on Website: Soul Origin may from time to
time amend, update or change this website including these Terms without prior
notice. Soul Origin is not liable to you or anyone if errors occur in the
information or if that information is not current. Product and price information
is subject to change without notice.
Collecting your Order: Orders must be collected
from the agreed Soul Origin location at the specified date and time. Soul
Origin is not liable for any orders not collected on time or at the agreed
location.
Delivery: It is your responsibility to ensure
products are collected promptly and stored appropriately after delivery. A
minimum purchase of $30 is required for delivery orders. If you are not present
at the time of delivery, goods can be left unattended, provided you have given written
or verbal consent when placing your order. However, Soul Origin takes no
responsibility for the condition of the product once left unattended. Please
note no temporary refrigeration or storage is provided if goods are left
unattended.
Cancellation of order: Order cancellations must
be made a minimum of 24 hours before the scheduled pick up or delivery for
orders due Tuesday through Friday. For orders schedule for pick up or delivery
on Saturday, Sunday or Monday, cancellations must be made by 2:00pm on the
preceding Friday. To cancel your order, please contact our customer service
team via the details provided below.
Refund Policy: If you are dissatisfied with any item, please notify
Soul Origin within 48 hours of pickup or delivery. Refunds will be considered
if notice is provided within this timeframe.

To assist us in processing your order cancellation or refund
request as quickly as possible, please provide the following details about your
order and the issue:
- Full name used when placing your order
- Contact email associated with the order
- Your order number (found in the confirmation email)
- For refunds, please supply clear images showing any damage or issues with the order.
Providing complete and accurate details will allow us to assist you more effectively.
If a catering replacement is not suitable, and a refund is requested, Soul Origin will make every effort to process it promptly. Please be aware that the refund may take up to 10 business days to appear in your
account, depending on your financial institution and the payment method used at
the time of purchase.
Allergen & Nutritional Information and Disclaimer: Nutritional details, including kilojoules (kJ), are listed on our website. Kilojoule values are listed as the total per platter unless otherwise specified.
Despite our best efforts, there is always a possibility that
traces of allergens may be present due to cross-contact during the processing,
storage, or preparation of products in our stores. Soul Origin cannot guarantee
a completely allergen-free preparation environment. As a result, we cannot
ensure that any product is entirely free from allergen traces, and no product
is sold as allergen-free.
In accordance with applicable laws, Soul Origin will not be
liable for any costs, fees, actions, claims, damages or charges (including
medical or dental expenses) arising from adverse reactions to any products
purchased from a Soul Origin store.
If you have a particular sensitivity to any listed
allergens, we strongly recommend contacting us for further information before
consuming any of our products. Please email us at catering@soulorigin.co.nz and
will be happy to provide guidance.

Privacy: When you place catering order and provide us
with your personal information, we will collect, process and store your
information in compliance with our Privacy Policy. You can access our Privacy

Standard Terms for Catering Products: All offers and
promotions provided by Soul Origin in relation to our catering are subject to
specific terms and conditions and may not be combined with any other offer or
promotion unless explicitly stated. Please note that certain menu items are
fixed and cannot be altered or customised.
Delivery services are not available in all areas, and a set delivery fee applies.
Soul Origin reserves the right to adjust prices and delivery
fees, make changes to menu items or withdraw products at any time without prior
notice.
Intellectual Property Rights: All material contained
on this website is the property of Soul Origin and its affiliates and protected
by copyright. Except as permitted by relevant copyright legislation or with the
prior written approval of Soul Origin or its affiliates, the material may not
be otherwise used, copied, reproduced, published, stored in a retrieval system,
altered, transmitted in any form by any means in whole or in part.
The trade marks appearing on this website are the registered
and non-registered trade marks of Soul Origin or their affiliates. The trade
marks are not to be used or modified in any way without the express written
permission of Soul Origin or the relevant affiliate.
Limitation of Liability: For the purchase of any
products or services through this website, to the extent permitted by law:
- (a) Soul Origin will not be liable for any incidental, consequential, or indirect damages, including but not
limited to loss or corruption of data, loss of profits, goodwill, opportunities, bargains, or anticipated savings. - (b) Soul Origin’s direct liability in connection with any product or service purchased through this website is
limited to the lesser of: - (i) the replacement of the purchased product; or
- (ii) the amount paid by you to Soul Origin for the product or service.
For any use of this website, to the extent permitted by law
(except as stated in the preceding paragraph), Soul Origin is not liable for
any direct, indirect, incidental, or consequential damages, including but not
limited to loss or corruption of data, loss of profits, goodwill,
opportunities, anticipated savings, or business reputation. This applies to any
issues arising from your access to, use of, or inability to use the website or
its content (including interactions with third parties encountered through this
site), regardless of whether the claim is based on warranty, contract, tort,
negligence, or other legal grounds, and whether or not Soul Origin was aware of
the potential for such damages.
If the law in a specific jurisdiction does not allow the
exclusion or limitation of liability as outlined here but permits a limitation
to a maximum extent, Soul Origin’s liability will be limited to that maximum extent.
Governing Law: These terms are governed by the laws of New Zealand.

GENERAL TERMS
1. The Promoter is Soul Origin (Australia) Pty Ltd (ACN 168 629 061), 580 Parramatta Road, Petersham NSW 2049.
2. By participating in any of the above promotions you agree and are automatically deemed to have read, understood and accepted these terms and conditions (Terms).
3. If there is any inconsistency between these Terms and anything else that refers to the promotions, these Terms will prevail.
4. The Promoter reserves the right to amend, cancel and/or suspend any promotion at any time, without notice.
5. By participating in any promotion, you:
a. consent to (without limitation) the collection, use and disclosure of your personal information in accordance with the Promoter’s privacy policy;
b. agree to be contacted by the Promoter through telephone, mail, electronic methods and any other communication methods; and
c. acknowledge and agree that the Promoter is entitled to perform any of the aforementioned actions without compensation, and that such consent is enduring.
6. Each promotion is not transferrable and cannot be exchanged for cash. Each promotion cannot be used in conjunction with any other offers of the Promoter.
7. The promotions cannot be applied to previous purchases.
Liability
8. You acknowledge and agree that the Promoter is not responsible or liable for:
a. the unavailability or inaccessibility of any service (including without limitation, the Soulmates app) whether or not caused by traffic congestion on the internet or at any website;
b. unauthorised human intervention in any part of each promotion;
c. electronic or human error which may occur in the administration of each promotion;
d. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); or
e. any delay, cancellation, postponement or attendance of a voucher, if applicable.
9. These Terms do not affect, and are not intended to affect, any rights a consumer may have under applicable consumer protection laws, which cannot be excluded. To the fullest extent permitted by law, the Promoter’s liability, or that of its franchisees, servants or agents, for breach of any such rights is limited to the cost of resupplying the voucher (if applicable).
Statutory Warranties
10. The Promoter does not exclude any rights or remedies in respect of goods and services under the Australian Consumer Law or any other relevant legislation which cannot be excluded, restricted or modified.
11. Notwithstanding clause 10 above, to the fullest extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever which is suffered, including but not limited to indirect, direct or consequential loss, or for any personal injury suffered or sustained in connection with any promotion except for a liability which cannot be excluded by law.
12. You agree to indemnify the Promoter and their respective directors, officers, franchisees, employees and agents (each an Indemnified Person) against any loss, cost, damage or expense suffered or incurred by an Indemnified Person as a result of:
a. your breach of any of these Terms;
b. any warranty given by you proving to be untrue; or
c. any personal injury arising from or related to any wrongful or negligent act or omission by you in connection with any promotion.
Privacy
13. The Promoter collects personal information about you for the purposes of conducting its promotions. Any disclosure of such information will be made in accordance with applicable laws and the Soul Origin Privacy Policy.
14. The Promoter may use your name and email address for future promotional, marketing and publicity purposes across any media worldwide, without further notice and without any fee, unless otherwise advised by you.
15. By participating in this promotion, you confirm your consent to the use of your details for these purposes. 16. The Promoter’s decision in respect of all matters to do with any promotion will be final and no correspondence will be entered into.
17. To the extent it is legally possible, these Terms are governed by the laws of New South Wales and the parties submit to the jurisdiction of the courts of New South Wales.
18. Any failure or delay by the Promoter in exercising its rights under these Terms does not constitute a waiver of those rights.
